In cases of car damage or theft, you may want to file an auto insurance claim. If the damaged is caused by another driver, you can file the claim with either your own insurance company or the other driver’s auto insurance company.

A claim you file with your own insurance company is called a “first-party” claim.

A claim filed against another driver’s company is referrred to as a “third-party claim”.

In a third-party claim, the contract is with the policy holder alone.

If You File a Claim With Your Own auto insurance Company

-you immediately report all damages directly to your auto insurance company.

-you immediately report all damages and losses to the police department, and then get a police report for the case.

-you must have the damaged vehicle inspected by the insurer before you have it repaired.

-you must endeavour to protect your vehicle from more damage,if it is in your ability to do so.

If You File a Claim with the Other Driver’s Insurance Company

The auto insurance company of the other driver will investigate the claim, and will give a settlement if their insured is legally responsible for your damages.

Often times, the auto insurance company expect you to sign a “release for damages” before your claim is settled.

A release means you accept that the amount offered is the only amount you will receive from the other driver and his/her insurance company.

What Information Must I Provide When I File a Claim?

-You are expected to report the auto insurance company promptly the details

the accident.

-Forward copies of any notices or legal papers you receive about the

accident.

-Your auto insurance company may also require you to show documents related to the

claim, such as medical etc.
